Recently a Wenatchee City Attorney was arrested and pled guilty to a DUI. Not too many weeks later a Kitsap County Prosecutor was arrested and charged with DUI (her second offense). Is it surprising? No not at all, the legal limit is very low and many people who have a couple, then believe they are legally driving after drinking find themselves in this situation. In both of these situations the attorneys declined to participate in breath testing. In a 2012 DUI arrest a, now former, Snohomish County District Court judge was stopped and ultimately arrested for a DUI. He also declined to take a breath test! Is this surprising, no it is their knowledge of the situation in which they were in. I certainly cannot speak to their mindset at the time, but I believe they understood breath tests, and especially field sobriety tests, are certainly subjective.
The point is, anyone can find themselves arrested for a DUI even though they were legally consuming alcohol, remember it is not against the law to drink and drive it is against the law to be impaired (under the influence of alcohol or illegal drug) while driving. Kitsap County Deputy Prosecutor Barbara O. Dennis was arrested on suspicion of drunken driving after a rear-end collision Wednesday in Poulsbo. The Washington State Patrol says Dennis was booked into the Kitsap County Jail. She posted bail and was released. Kitsap County Prosecutor Russ Hauge (HOG'-ee) has referred the case to Pierce County to avoid any conflict of interest.The Kitsap Sun reports (http://bit.ly/1fp4GbW ) Dennis was previously charged with drunken driving in 2007. The charged was reduced to negligent driving and Dennis complied with court-ordered.
